The Separation of solid waste at source was enforced in 2011 under the Solid Waste and Public Cleansing Management (Scheme for Household Solid Waste and Solid Waste Similar to Household Solid Waste) Regulations 2011. Prior to the enforcement implementation, which began on 1 June 2016, SWCorp had previously drafted three (3) Phases: the Management Phase (1 June 2015 – 31 August 2015), the Reminder Phase (1 September 2015 – 31 May 2016) and the Enforcement Phase (1 June 2016). These regulations involve seven (7) states that have adopted Act 672, being Johor, Melaka, Negeri Sembilan, Pahang, Perlis, Kedah and the Federal Territory.

Enforcement is carried out by SWCorp Enforcement Officers, who have been given the authority to carry out inspections of landed and multistorey premises. They inspect bins and waste containers to ensure that waste separation at source is being carried out by household. If not implemented, a Notice of Violation (NPK) will be issued and an investigation paper will be opened resulting in a minimum fine of RM50 for landed premises and a minimum fine of RM100 for multistorey premises.

A total of 1,642,901 landed premises and 535,591 multistorey premises have been involved in this implementation, covering 53 local authority operation areas across seven (7) states. For landed premises, actions would be taken against the occupants or owners, while for multistorey buildings, enforcement would be directed at the Joint Management Body (JMB).

Enforcement involving landed premises began on 1 June 2016, while enforcement involving multistorey premises started on 1 May 2021. The implementation of solid waste separation at source enforcement aims to cultivate the habit of separating waste according to categories among the community. This enforcement is the last resort action and will only be taken if members of the public continue to neglect the action of waste separation.

For landed premises, 17,543 operations have been carried out since 2016, involving 1,1414,045 premises and 25,976 gardens. Additionally, 715 Notices of Violation have been issued, with fines totalling RM18,300.00 being imposed on premises owners who violated the regulations. Since May 2021, 485 operations have been carried out involving 692 Joint Management Bodies (JMB) and 195,242 multistorey premises. To date, no Notices of Violation or fines have been issued.
Landed premises:
a. First offence : RM50.00
b. Second offence : RM100.00
c. Third or subsequent offences : RM500.00

Multistorey premises:
d. First offence : RM100.00
e. Second offence : RM200.00
f. Third or subsequent offences : RM500.00

If the compound is not paid within the specified period, SWCorp will bring the case to court and upon conviction, a fine of up to RM1,000 may be imposed.
